This question is specific to Indian nationals with children born in US.
Has anyone on H1 or pending 485 received OCI for their US born child? We were able to get OCI for our first child a few years ago but the rules seem to have changed and cgisf.org states that a child whose both parents are Indian citizens can't get OCI. Any ideas? Is PIO the right option now?

As many of you assured me, the date on the I-94 reflected the date on my I-797 (I received a B, not an A). It did not have anything to do with my passport expiration date as I was fearing. Thanks everyone!

I recieved my I-485 reciept directly in the mail from USCIS. My attorney got his copy to thier address. I think you need to ask your employer. Since I-485 belongs to the employee, there is no reason for them to hold the original with them.
Could you share how you received the original 485 receipt? I only received a copy of the receipt. Can we request one from USCIS?

Background:

Currently CIS and Statedept count ebdependents / derivatives under ebquota (according to CFR22)
However Sec 203, INA seems to layout the eb quota volume and lists eligibilities.
Looking at INA I am unable to find the link between ebdependent/detivaties and ebquota.
The I485 application "Part 2: App Type" Option b (derivative status for spouses and children)
seems to be related to quota listed in INA Sec. 203. [8 U.S.C. 1153] a - 2. (family quota)
and seems to be not related to INA Sec. 203. [8 U.S.C. 1153] b - * (employment quota).
Question:

What quota do dependents of Employment based AOS(I-485) LEGALLY fall into - is it the EB quota or FB quota?
If incorrectly classified ? Is there any legal option this mis-classification be corrected?

This means that if primary beneficiary is using visa number from EB(2) classification then dependent(s) will also be using same classification as primary beneficiary (i.e. EB(2) in this example).

You really got to be kidding us. The 8 people I know of in EB3 during these period is still waiting.
actually, i think that the EB3 will also make rapid advances come October.
with the quota exhausted for this year, and the pre-adjudication taking place and with most of the EB3 India applicants having received their GC between 2002 and 2005, i think the dates will advance to 2003 by Dec and to mid 2004 by Feb/March. After that, it is anyone's guess if the quota for India will hold out. As for me, I see at least another year or two wait for my GC, unless the Congress passes a miracle.

Hi,
My I-94 which was issued 2 years ago in the port of entry got expired(this I-94 was based on my previous employer "ABC". I have applied for H1 extention and got my 797 extended with new I-94 recently with my new employer "XYZ".
My question is which I-94 details should I use while filing my 485. Obviously my labor was filed by "XYZ" company.

Use the latest (and valid) I 94. The one that came with the H1 extension.

Thank you for posting this enlightning article. I think some of it is very true, give it fifty years and oriental Asia will have become an even greater threat to the US� leadership, if not ended it completely. I�ve never looked into this, so I�m asking: Aren�t there different immigration rules that aren�t as strict when you actually study in America? Recently we are seeing lot of people with new id without completing profile they are able to start new thread. What if admin enforced new user to fill the personnel information and then only they can post on this web site. More importantly some key massages\important issues get berried in active forums due to above issue.
Even going further we can put trial period for new users for 15 days .If they have any questions just pay 5-10 $ and get active in forum there answers will be provided by all our valued/all star members (most green as per rank) in this way we get more revenue and members get valued advice.
I totally disagree with this idea.
infact, for posting onto a forum or replying, there should be minimal registration info required, i would say, the handle, email id, password and the captcha and thats that.
IV should not kick into protective mode cos of one tunnel rat.
the site and the forums should attract people from all walks of life, regardless of their immigration status.
what if i m a lawyer and want to respond to things or post new threads?
what if i m a citizen and want to reply to something i know?
what if i m a father of a h1b trying to find an answer on tourist visas?
I dont want a lengthly registration form for that.

I can hardly find any paystub beyond 6 months, in my case. I hope and pray that I dont get an RFE like that. Do people really keep all the paystubs they ever received from employers? that is an outrage.

The technique you mention works best when you reverse a normal or wide lens in front of a telephoto lens. However, none of my lenses work very well; all cause severe vignetting. The cheapest way to try this is to hold the one lens in front of the other with your hand; then focus the apparatus by moving the whole system in and out until you find the plane of focus (autofocus is worthless for any macro above 1:1, and IMHO even for most macro below it). If you like what you see, then it's not a great expense to find an adapter that has filter threads on both sides of it to hold the lenses in place for you. Check the macro couplers (http://www.bhphotovideo.com/bnh/controller/home?O=NavBar&A=search&Q=&ci=3066) section at B&H for the kind of adapter you'd need.
I still think a regular macro lens would be most versatile (you can go from infinity down to 1:1 without removing the lens or unscrewing any filters), but the other method can be a cheap way to experiment, if you can find a pair of lenses that gives you the magnification you want without major vignetting.

Is it true it is must to use EAD to invoke AC 21? I am not sure but people said I cannot use H1 but EAD to invoke Ac 21........
