I was in a similar situation as you and had to use this firm. H1B filing experience was fine but the entire GC process and filing was not a good experience at all. There were days I had to call the paralegal and teach him the new immigration laws and that's never a good sign ! Because of their mistake I was stuck in Eb3 rather being in Eb2. May be they will deal differently with your case but have a chat with them and your company managers before you agree to use them. I m with another company and another attorney firm and they are awesome !

To my knowledge H1B extension is just like a new H1B application ofcourse 6 years window will be couted here and you have spent just 3 years. To me you can file H1B extension with multiple companies. But its better to file it with original company to be on safe side, onece the extension approval come ytou can trasfer it whereever you want.

I got an RFE to send copies of my degrees on nov 15th. my attorney sent the copies and my status changed to Response to request for evidence received and processing is resumed. How many days will it take for I-140 approval after the response to RFE to received by USCIS ?

I have similar issue and spoke to my Immig Attorney, who advised me as follows-
(1) In order to maintain your resident alien status, you should be in USA more than 181 days, in other words it is adviseable to stay less than 180 days outside USA.
(2) It is adviseable that you return to USA, ASAP, once you get CRIS email that GC approval has been provided.
(3) I believe you are going to use AP. You would prepare your I-94 card at the POA and the POA officer would ask you where you are employed before putting stamp on I-94. Be prepared to answer that question. Most likely 99%, the POE IO will not ask any proof. However, it is adviseable to have a current job (sort of Employment Verification Letter) and leave letter approval.

We got our EAD cards today.
We had gone for FP on Sept 19th and saw LUDs on Sep 20th on our I-485s. But the EAD cards came without our fingerprints. EAD cards came from the same Service center (Nebraska) where the FP notices came from. So wondering, how they did not include our fingerprints in the EAD card?? I had also checked with FBI helpline two weeks back and verified that the FPs were delivered to USCIS.
Anybody else in similar situation?

My lawyer checked my application type as
"h", and stating "Spouse has an approved I-140"
Since I am filing as dependent. Should it be "b" " my spouse or parent applied for adjustment..."

I just finished an intership with a company that does essentially what you do, except that they are already established in the Philadelphia Area. I don't know much, but I think your best bet would be to contact local businesses that might need multimedia stuff. Also, put some time into making a really /really/ kickass site, being as it is what is selling your services.

Are there any risk factors involved in changging the job by invoking AC21 ??
its not any more or less risker than someone who is not married or whose spouse has already filed 485 (ie. your special case makes no difference to your using AC-21): only thing to consider is: what visa is your wife on, if H4, then you must change jobs using H1. You will need to stay on H1 until your PD is current and your wife is able to file her 485.

I filed my I-485 in July 07 at Nebraska service center and my wife had her finger printing done a month or so ago but I am yet to get the notice. Is there some number I can call and check. My Lawyer is very uncooperative in this case.

Some where I read that there is no fee for renewal of AP. I am a Jul 07 filer and am not sure about this. Further already applied last year for Advance parole and traveled once. it got expired last month. I am applying for a new one again. So just wanted to know if I need to pay the fees $305.
So my questions are:
Does July 07 filers need to send the cheque for $305 for AP renewal. (My I 485 Reciept Date is Aug 2007)
Should we also include Biometric fee of $80?
And how much time approx is it taking these days for AP?

certainly there is a possibility for delay with pretty much anything that involves immigration. when does your current H1 expire? Even if it expires since you have a pending application, the reciept notice would possibly suffice to continue in legal status. I am definitely not an expert. Others might provide better idea.

Hello,
I spoke to my lawyer today and she made it very clear that it is ILLEGAL to file more than one I-485 for one applicant (from 2 diff companies). USCIS will immediately ask you to make a choice.

2) How much time does it take for the AP extension to get processed (TSC) if I were to apply for an extension of my old AP today?

Would also add a buffer of 2 weeks (just in case).
