My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.
My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?

By chance, I was browsing the USCIS homepage when I came across guidelines for the change of address form. It says that not changing your address within 10 days is a criminal misdemeanor. Does anyone know when this law was passed?

Hi,
I have applied 485 through a lawyer. The lawfirm sold their company to some one else. I was asked to file G28 and I didn't file for G28 yet.
I got a mail saying I was sent RFE n Feb 4th. I haven't received the letter yet. Would the RFE go to lawyer or me?
What should I do now?

The reporter has already talked with me and two other IV members. we do not make good cases for her. The main theme of her article is 'highly skilled immigrants leaving USA because of retrogression'. Well I have been waiting for a reply, seems like no one has answered my question. Can someone please post some suggestions. urgent
You have 2 options. Either use your old H1 which is still valid (assuming u still have a valid visa stamp) and enter US (carry a latest offer letter from employer). If you use the old H1, then you will only have 2 more years of H1 time left.
You can file for a fresh H1 visa in Master's quota under consular processing and when its approved, attend the Visa interview, get a new H1 stamp, and re-enter using the fresh stamp. This way, you will get fresh 6 yrs time on H1.

My wife'e H1B expires on Feb 2007 and she still has not applied for H1B renewal as she was on maternity leave. She will do so in first week of November. It looks like H1B extension process takes more than 3 months. Virginia is one of the states which just gives ur Driver license till ur H1B validity. So her license is valid till feb 2007. Would like to know if she can get her license renewed in Feb 2007 with a H1b receipt number or should she do Premium processing of her H1B. Any help is greatly appreciated.

How ever call Identity Services (dont remember the division's name exactly) @ 804 367 0064 and explain your situation. They are the folks that generally issue a letter for H4 visa holders who do not have a I 797. They will take atleast 1 month to send the letter once they decide to do it. Start acting now! Good luck.

i am confused. is that safe if i do h1b transfer and keeping old employer's i140.(they won't revoke).Are its better to use ead to avoid confusion in GC process.pls show me the light.

Big goof up on AP document, my spouses document had my alien number. Thankfully, they recognized it as a USCIS mistake and let her in. She had to wait 3 hours for processing, they also took both AP forms and set up and appointment at USCIS office in SF.
I have to go to SF tomorrow. Couple of qns that some one may be able to answer
1) What should i expect tomorrow?
2) When im there can i ask them any question regarding the status of my case?
On a separate note, i heard from a friend that AP is getting approved in 15 days now. Is that a one off case?

I wanted to know is it possible to file Green Card, once my petition is renewed, on my own even if employer is not interested in doing it. I am ready to pay my expenses and get it filed. Just wanted to know if it is possible. I have been with my employer for 4 years.

All Employment Based green cards must be filed/sponsored by an employer.
You cannot file by yourself.

When i contacted my employer, he says my petition is approved. But still when i find the status online, it's not reflected.
What could be the problem?
Any thoughts would be highly aprpeciated.

What are those little green squares that show up with our names when we post something?? When you hover over them you see a ToolTip message.
