Make sure that your new reporting manager is aware of your GC process. I had a manager earlier, who midway through my LC process decided he will not support the GC, since he was not my manager who hired me, since i was moved to another group, after my LC was filed...........If needed go up the ladder for buy-in

Hi friends
I am currently on H1B, which was recently approved under cap exempt for a non-profit employer.But, now I 'd like to work for a profit employer ,which comes under quota .So, can't I change to this new capped employer by filing a new petition at this time where there is no quota available or should my H1B be counted against cap once in the six years period to be able to change employers whether they are profit or non-profit employers? Could anybody please give me some input with all your previous experiences.Thanks in advance.

Hello guys,
I am sending my family based I-485 on May 1. currently i am on h1b . My h1b approval (I-797A) is valid till April 15, 2009. my h1b extension is already pending with USCIS. My Question is :::----
Is there gonna be any problem with USCIS since my h1b approval already expired?? what will be my status after i filled my I-485?? Can i legally stay in US after filing family based I-485 even my h1b extension get denied.???

if monthly wages for an employees is 1000 per month then it should be 12000 per year) company need to prove the ability to pay $12000 per year.
but what if the LC was filed in mid year for example June 2005 and CIS RFE is asking to proof ability to pay (only One year) 2005
can it been showed as June - december = 7 month and onwards
$1000 x7= 7000
is it good approch or no

It is not an issue for people of Indian origin who are returning, of planning to return, back to India for whatever reason. They are the lucky (?) ones to have either a Indian passport or PIO card or OCI card so they are eligible to work on that basis.
But how about those who do not qualify for one of the above? There is an increasing number of foreigners working in India - how do they become eligible to work in India? Is there an equivalent of an H1B, or may be oneday GC & Citizenship?

As far as I know when I was in school getting my PhD (2003-2006) they had introduced a new rule saying that you could only get another OPT when you go for a higher degree. Example I did MS, use my OPT. If I go for higher degree like PhD I will get another OPT but if I go for another Masters I will not get an OPT since I used mine during first Masters. But please check with the rules in the school (contact the International Office and verify this).
